Terms of Service
Effective date: October 30, 2026
Welcome to Cookie.Fund. These Terms are an agreement between you and CookieFund (DBA), a business registered in California ("Cookie.Fund," "we," "us") for using cookie.fund. By using the site, creating an account, running or joining a fundraiser, or placing an order, you agree to these Terms and our Privacy Policy.
Plain-language summary: Organizers apply to run fundraisers, sellers share links, supporters buy cookies by card, we ship the cookies, and the team keeps 60% of cookie sales, paid out through Stripe.
1. Who can use Cookie.Fund
- Fundraisers can be run by schools, sports teams, bands, dance studios, scout troops, church groups, booster clubs, nonprofits, and similar groups.
- Organizers (the person who sets up the fundraiser and its account) must be at least 18 years old and authorized to raise money for the group they name.
- Only an adult (18+) organizer can create a fundraiser and its account.
- Sellers (participants) must be at least 14 years old. Sellers don't create their own fundraiser. They take part in one an organizer has set up, using their own participant code or link that the organizer creates and shares with them.
- Organizers are responsible for inviting only appropriate participants who are 14 or older, and for making sure any seller under 18 has a parent's or guardian's okay to take part.
- Cookie.Fund is not directed to children under 13, and no one under 14 may sell.
- You're responsible for keeping your login secure and for activity on your account.
2. Fundraiser applications
- Organizers apply by creating an account and submitting the fundraiser's name, goal, and end date.
- Within 24 hours of an application, we email the organizer to let them know if and when we can take on the fundraiser and where it is in line behind other waiting fundraisers. We may approve or decline any application. A fundraiser and its 6-digit fundraiser code go live once approved.
- We may decline or remove a fundraiser that misrepresents who it's raising money for, raises money for an illegal or prohibited purpose, isn't run by an eligible group, or otherwise violates these Terms.
3. How fundraisers work
- Each approved fundraiser gets a main fundraiser page and a 6-digit fundraiser code. Supporters use the code or URL to open the main page and shop or donate to the team as a whole.
- From the dashboard, the organizer creates a participant for each seller. Each participant gets their own participant code or link and seller page, set up as a sub-account under the organizer's main fundraiser account.
- Sales made through a participant's code or link are credited to that participant and shown on the fundraiser's leaderboard. All sales count toward the fundraiser's total.
- The organizer sets the fundraiser's goal and end date.
- Supporters can also add optional donations ($1 to $10,000), which count toward the fundraiser's total. Donations are non-refundable.
4. Fundraiser earnings and payouts
- The fundraiser keeps 60% of every cookie sale. Shipping and tax are charged to buyers separately and are not taken from the team's share.
- Donations count toward the fundraiser's total and are split the same way as cookie sales, so the team keeps 60% of every donation. There are no extra fees on donations.
- Payouts are made through Stripe Connect. The organizer connects a bank account once and requests a payout when the fundraiser ends. Payouts are sent within 3 business days after the fundraiser ends. By using payouts you also agree to Stripe's Connected Account Agreement.
- Every sale is recorded on a ledger the organizer can review.
- Refunded or charged-back orders are deducted from the fundraiser's earnings at the same share they were originally credited at.
- Organizers are responsible for using funds for the stated purpose and for any tax or reporting obligations of their organization.
5. Orders, payment, and products
- Cookies are sold only through fundraisers, using a participant's code or link or the 6-digit fundraiser code.
- Supporters pay for cookies and donations by card through Stripe.
- We currently ship only to addresses within California. We'll update our Shipping & Returns policy if that changes.
- Prices are shown at checkout. Shipping rates are calculated live from the delivery address and shown at checkout so you can choose an option before paying. Applicable tax is added at checkout. Local pickup is available when the fundraiser offers it.
- Our cookies are made by Fontana Cookies (FontanaCookies.com). Availability, flavors, and pack sizes may change.
- Allergens: Ingredients and allergens may vary by cookie, and no cookie can be guaranteed free from allergens or cross-contact. See Fontana's ingredients & allergen information before ordering.
- Damaged-item and wrong-order claims (3 days from delivery or pickup, with a photo), cancellations, and refunds are covered by our Shipping & Returns policy.
6. Acceptable use
Don't misuse Cookie.Fund. For example, don't: misrepresent who you are raising money for; use the service for fraud or illegal purposes; harass others; interfere with the site's security or operation; or scrape or copy the site without permission.
7. Our content
The Cookie.Fund name, logo, site design, and product photos belong to CookieFund (DBA) or its licensors. You may share your fundraiser and seller links, but please don't use our branding in ways that suggest an endorsement we haven't given.
8. Ending or suspending accounts
We may suspend or close accounts or fundraisers that violate these Terms. You can close your account by emailing Info@cookie.fund. Earnings already recorded on the fundraiser's ledger remain payable to the team through Stripe Connect, minus any refunds or chargebacks, unless the fundraiser was removed for fraud.
9. Disclaimers and limitation of liability
10. Disputes and governing law
These Terms are governed by the laws of the State of California. [DISPUTE RESOLUTION: courts / arbitration clause, to be set by your lawyer.]
